Petición familiar

El proceso de petición familiar es un recurso que tienen tanto los ciudadanos como residentes permanentes para unificar a su familia que se encuentra en otros países y/o fuera de estatus. 

Por medio de este proceso, el beneficiario puede obtener una tarjeta de residente permanente si cumple con todos los requerimientos exigidos.

El proceso de petición familiar implica presentar una solicitud ante el Servicio de Ciudadanía e Inmigración de Estados Unidos (USCIS) para obtener la aprobación de la petición. La elegibilidad para realizar una petición familiar varía dependiendo del estatus migratorio del solicitante y la relación familiar con el beneficiario.

Las peticiones familiares más comunes incluyen:

  1. Petición de Cónyuge: Un ciudadano estadounidense o residente legal permanente puede solicitar la visa de inmigrante para su cónyuge extranjero/a.

  2. Petición de Hijos/as: Un ciudadano estadounidense puede solicitar una visa de inmigrante para sus hijos solteros o casados y menores o mayores de 21 años, mientras que los residentes legales permanentes pueden hacerlo para sus hijos solteros, ya sean menores de 21 años o mayores.

  3. Petición de Padres: Los ciudadanos estadounidenses pueden solicitar una visa de inmigrante para sus padres.

  4. Petición de Hermanos/as: Los ciudadanos estadounidenses pueden solicitar una visa de inmigrante para sus hermanos/as, siempre y cuando sean mayores de 21 años.

 

Es importante tener en cuenta que el proceso de petición familiar puede ser complejo y estar sujeto a cuotas y tiempos de espera, dependiendo de la relación familiar y el estatus migratorio del solicitante y el beneficiario.
