Venezuelans in Immigration Limbo as TPS Expires in the U.S.

Temporary Protected Status (TPS), which protects thousands of Venezuelans in the United States, is set to expire in 2025. Following the decision by Donald Trump’s administration to revoke the extension previously approved by Joe Biden, more than 500,000 Venezuelan migrants could face immigration limbo.

According to the U.S. Federal Register, the validity of TPS for Venezuelans is as follows:

  • Venezuelans who applied in 2021: Their TPS remains valid until September 10, 2025.


  • Venezuelans who applied between January and March 2024: Their TPS expires on April 2, 2025.


Many immigrants trusted TPS as a legal solution to stay in the U.S., but now they face an uncertain future.


Once TPS ends, each individual will revert to their previous immigration status:


  • Those who have been in the U.S. for less than 2 years: Could face immediate deportation.


  • Those who have been in the U.S. longer: Will enter removal proceedings, which could lead to deportation in the following months.

 

Immigration experts have identified four possible scenarios depending on each person’s legal status:


  1. Venezuelans with TPS and a pending asylum application: Will remain protected until their case is resolved.


  2. Venezuelans with TPS and previous illegal status: Face a high risk of deportation. They could only legalize their status if they have a U.S. citizen relative or obtain a student visa.


  3. Venezuelans with Humanitarian Parole and TPS: May apply for asylum, though processing times are lengthy.


  4. Venezuelans who crossed the border and obtained TPS: If they did not regularize their status, they could face deportation once their protection is lost.

 

According to the Department of Homeland Security (DHS), the TPS extension "was not properly carried out."


Secretary Kristi Noem explained that:


  • The extension was granted too far in advance.


  • TPS programs from 2021 and 2023 were merged into a single measure, which does not comply with regulations.


  • The extension should have been processed 60 days prior to expiration, not years in advance.

 

Venezuelans under TPS may avoid deportation if they can prove they face danger in their home country. According to USCIS, valid reasons for seeking protection include:


  • Political persecution.


  • Discrimination based on nationality, religion, or race.


  • Risk of violence or threats to their life.


Immigrants who have already started a legalization process will not be affected by the TPS cancellation. However, those without any other legal option could face imminent deportation.

 

The cancellation of TPS for Venezuelans in 2025 will leave thousands of immigrants in a vulnerable situation.
